Find Cibola County Clerk Records

Cibola County Clerk records include recorded county documents, marriage licenses, elections records, ordinances, resolutions, deeds, and mortgages. The elected County Clerk is separate from the court clerk who maintains court case files. A Cibola County Clerk records search should focus on county-held records, recording services, marriage-license copies, and county IPRA requests. Court case copies, divorce decrees, criminal judgments, and court pleadings should be requested from the proper court clerk or New Mexico Courts IPRA.

Marriage Licenses and Copies

Marriage licenses issued for marriages within Cibola County are County Clerk records. New Mexico Department of Health routes marriage-license copies to the county clerk where the license was issued, and NMDOH does not issue marriage copies. A couple must obtain a county-clerk marriage license before a New Mexico ceremony and file the completed license for recording in the issuing county after the ceremony.

Cibola County's Probate Judge may perform wedding ceremonies free of charge, but the Probate Judge ceremony is separate from the County Clerk license function. The ceremony page says ceremonies may be performed in English or Spanish, generally in the Cibola County Commission Chambers, with witnesses available upon request and reservations highly encouraged.

County IPRA Requests

Cibola County's Transparency page gives the local public-records process under the New Mexico Inspection of Public Records Act. It states that every person has the right to inspect Cibola County public records. The Cibola County Board of Commissioners designated the Recording and Filing Deputy Clerk as the county's public-records custodian, and the County Clerk is the official keeper of all recorded records for the county.

A person may submit a request orally or in writing to the County Clerk's Office, but formal procedures and penalties of the Act apply only to written requests. A written request must include the requester's name, address, email address, and telephone number, and it must describe the records sought in enough detail for the records custodian to identify and locate them.

Court Records Do Not Come From the County Clerk

Court case records are maintained by the court clerk for the court where the case was filed. Cibola District Court records, divorce decrees, family case documents, felony case records, and contested probate litigation should go through District Court, New Mexico Case Lookup, re:SearchNM, or New Mexico Courts IPRA. Magistrate cases should go through the Cibola County Magistrate Court or the appropriate court system channel. Grants and Milan municipal cases should be checked with those municipal courts when the case started there.

New Mexico Courts IPRA states that courts do not conduct public criminal background checks and do not maintain law enforcement records, motor vehicle driving records, or marriage licenses. That means requesters often need different offices for different record types: County Clerk for recorded county documents and marriage licenses, court clerks for case files, law enforcement for incident or arrest records, and MVD for driver records.
